The Ninth Circuit Court of Appeals continued Judge Vaughn Walker’s stay pending appeal. On the plus side (and I’m grasping here), the appeal was expedited, which means the process will move faster than it might otherwise. And given that pretty much everyone figured this was going to the Supreme Court, this means we’re one step closer.
I don’t know how I’ve missed Prop 8 Trial Tracker for all this time.
Let me preface this link by reminding everyone that I’m not a lawyer, so I don’t fully understand half of what’s being discussed here, but here’s what I’ve gathered: at least part of the appeal will have to do with whether or not the appellants have standing, i.e. can prove they’ve been harmed by this ruling. This matters because the state of California isn’t going to appeal Judge Walker’s ruling, which means (as I understand it), if the Prop 8 supporters don’t have standing, this thing could be over at the 9th Circuit level. Or maybe not. You wade through the legalese.
